Croatian Competition Authority fines the supplier for prohibited vertical agreement

The Croatian Competition Agency ('CCA') announced that it fined Spinnaker distribucija d.o.o. ('Spinnaker') with 350,000 HRK (almost 50,000 EUR) for distorting competition on the Croatian market of the distribution of point of view sports cameras ('GoPro cameras').


Apparently, Spinnaker concluded several selective distribution agreements based on its standard template, for the period between 1 April 2018 and 31 March 2019, containing provisions obliging distributors to purchase GoPro cameras exclusively from Spinnaker and prohibiting them from selling products to other distributors, including within the network.


The CCA qualified this as a restriction by object, therefore did not analyse effects of such behaviour on the relevant market. The decision has not been published yet, and we will provide a more detailed overview once it is.
