Evaluation of the Motor Vehicle Block Exemption Regulation ('MVBER')

Context

The MVBER provides for a safe harbour under EU competition rules for vertical agreements in the automotive sector. The current MVBER (Regulation 461/2010) was set to expire on 31 May 2023. When reviewing the rules in 2022, the Commission decided not to fundamentally change the rules just yet, given the ecological and digital transformation that the automotive industry was undergoing. Instead, the Commission extended the MVBER with another five years, until 31 May 2028. It merely introduced some updates in its Supplementary Guidelines for the motor vehicle sector.
 

Next step

On 28 February 2025, the Commission launched a public consultation to gather insights from stakeholders. These insights will help the Commission in evaluating the MVBER’s impact and identifying areas for improvement. The goal of the evaluation process is to ensure that the new MVBER remains effective and relevant in the near future.
