BREAKING NEWS - The Regional Administrative Court in Brno annulled the Czech Competition Authority’s ('CCA') decision in the Baby Direkt case, in which the record fine amounting to the 10% statutory limit was imposed for the very first time.

After a first reading of the judgement, it seems that the Court requires the CCA to prove resale price maintenance in each individual supplier-buyer relationship. The Court stated that it is not possible for the CCA to simplify its investigation by using an unverified assumption that the practice concerns the entire relevant market(s). However, it is likely that the CCA will appeal to the Supreme Administrative Court.
