(1) Abusive exploitation, by one or more undertakings, of the relationship of economic dependence whereby an undertaking which has a position of customer or supplier, even in relation to a certain type of products or services, and which has no equivalent alternative, is prohibited. solution. This abusive exploitation of the relationship of economic dependence may consist in particular of the imposition of arbitrary terms of trade, discrimination or the abrupt and unjustified termination of long-term trade relations.
(2) Any person with a legitimate interest may claim cease and desist of the infringement and compensation for any damage suffered in breach of paragraph 1 of this article.
(3) Any person individually or as a representative of a legal entity acts in violation of this article, shall be punished by a fine of five thousand (5,000) euros to fifty thousand (50,000) euros. In case of recurrence the above fines are doubled.
